1. Acceptance of Terms

Welcome to Good Heart Foundation — thank you for being part of a community that helps neighbors across America. By accessing or using the Good Heart Foundation website, donation checkout, and related services (together, the "Platform"), you agree to be bound by these Terms of Use ("Terms"), which form a binding legal agreement between you and Good Heart Foundation. If you do not agree to these Terms, please do not access or use the Platform.

These Terms apply to everyone who uses the Platform, including visitors, donors, and campaign organizers. They incorporate by reference our Privacy Policy and our Refund & Cancellation Policy, which together govern your use of the Platform. Please read all three documents carefully.

By using the Platform, completing a donation, or submitting a campaign, you accept these Terms electronically, and you agree that this electronic acceptance has the same legal effect as a handwritten signature. If you are using the Platform on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. About Good Heart Foundation & the Platform

Good Heart Foundation is a United States–based 501(c)(3) nonprofit charitable organization (EIN 38-4409571), operating a charitable crowdfunding platform since 2024 and serving communities across America. Our mission is to connect generous donors with campaigns and causes that make a real difference.

Good Heart Foundation operates the Platform as an intermediary that connects donors with campaigns and campaign organizers. Except where a campaign is organized by Good Heart Foundation itself and clearly identified as such, we are not the ultimate beneficiary of the funds you donate, and we do not control how an organizer uses funds once they are released. We provide the technology, payment facilitation, and tools that make giving simple, secure, and transparent, but the underlying charitable work is carried out by the campaigns and organizers you choose to support.

3. Eligibility & Age Requirements

To make a donation or start a campaign on Good Heart Foundation, you must be at least 18 years old and have the legal capacity to enter into a binding contract. By using the Platform, you represent and warrant that you meet these requirements.

If you are under 18, you may use the Platform only under the supervision of a parent or legal guardian who agrees to be bound by these Terms. You also agree to use the Platform only for lawful purposes and in compliance with all applicable federal, state, and local laws and regulations, and not to use the Platform where doing so would be prohibited in your jurisdiction.

4. Accounts & Access

Good Heart Foundation is built to be simple and frictionless. You do not need to create an account, register, log in, or set a password to make a donation. There are no donor dashboards or stored login credentials — to support a cause, you simply choose a campaign, select a donation amount, and complete a secure checkout.

You agree that any information you provide during checkout or campaign submission — such as your name, email address, and payment details — is accurate, current, and complete, and that you are authorized to use the payment method you provide. Because we do not operate accounts or donor logins, we strongly recommend that you keep the confirmation email and receipt you receive after each donation. If you ever have a question about a contribution, our support team can assist you using the details on your receipt — see our Contact page and our Refund & Cancellation Policy.

5. How the Platform Works

Giving through Good Heart Foundation takes just a few steps, and we want you to understand exactly how it works before you contribute.

  • Browse campaigns. You can explore active campaigns and causes on the Platform and review the description, goal, and updates provided by each organizer.
  • Choose and donate. When you find a cause you want to support, you select a one-time or recurring (monthly) amount and complete a secure checkout handled by our third-party payment processor.
  • Funds flow to campaigns. Donations are collected through the payment processor and directed to the applicable campaign or organizer, less any disclosed platform and payment-processing fees. Campaign organizers may be required to verify their identity and fundraiser details before funds are released.

Good Heart Foundation reserves the right to request additional information and to delay, suspend, restrict, or decline the release of funds, or to remove any campaign, in cases of suspected fraud, misuse, incomplete verification, or violation of these Terms.

6. Campaign Organizer Terms

If you create or manage a campaign, you take on an important responsibility to your donors and to the community. By submitting a campaign, you agree that:

  • All information you provide is truthful, accurate, complete, and not misleading, and you will promptly correct any information that becomes inaccurate.
  • You have the legal right and authority to raise funds for the stated purpose and, where you are raising funds on behalf of another person or organization, you have their permission to do so.
  • Funds raised will be used solely for the purpose described in your campaign and delivered to the intended beneficiary.
  • You will provide honest, timely updates to your donors as your campaign progresses.
  • You will cooperate with identity and fundraiser verification and provide any documentation we reasonably request before funds are released.
  • You are solely responsible and accountable for your campaign, the accuracy of your representations, the proper use of funds, and compliance with all applicable laws, including any tax and reporting obligations.

Good Heart Foundation may, at its reasonable discretion, hold, delay, or return funds, and may remove or suspend a campaign, if we believe these obligations are not being met. Nothing in these Terms makes Good Heart Foundation responsible for an organizer's use or misuse of funds.

7. Donor Terms

Donations made through Good Heart Foundation are voluntary contributions intended to support the cause described in each campaign. When you give, you acknowledge and agree that:

  • Your contribution is voluntary and made at your own discretion based on the information presented in the campaign.
  • Good Heart Foundation does not guarantee any specific outcome, timeline, or result for any campaign, fundraiser, or beneficiary, and does not guarantee that a campaign will reach its fundraising goal.
  • You will receive a confirmation and receipt for your donation, which we recommend you retain for your records.
  • Any tax matters relating to your donation are your responsibility; see the Tax Receipts & Deductibility section below.

We take donor protection seriously. In cases of duplicate charges, an incorrect amount, payment or technical errors, unauthorized transactions, or confirmed fraud or misuse, we will review your request fairly and may issue a refund as described in our Refund & Cancellation Policy. If you ever have a concern about a donation or believe a campaign is fraudulent, please contact us right away.

8. Prohibited Campaigns

To keep our community safe and trustworthy, certain campaigns are not permitted on the Platform. Prohibited campaigns include, but are not limited to, those that:

  • Promote, fund, or facilitate illegal activity of any kind, or violate any applicable law or regulation;
  • Are fraudulent, deceptive, or misleading, or misrepresent the organizer, beneficiary, or use of funds;
  • Promote hate speech, harassment, violence, terrorism, or discrimination against any individual or group;
  • Support the sale or use of weapons, ammunition, illegal drugs, or controlled or regulated substances;
  • Involve gambling, lotteries, pyramid or multi-level marketing schemes, or speculative financial or cryptocurrency ventures offered as an investment;
  • Fund political campaigns or candidates in violation of applicable law, or involve bribery or kickbacks;
  • Promote sexually explicit, pornographic, or obscene content, or exploit or endanger minors;
  • Infringe the intellectual property, privacy, or other rights of any third party;
  • Relate to the collection of funds for legal defense of violent, hateful, or financial crimes, or are otherwise, in our reasonable judgment, harmful to the Platform or the community.

Good Heart Foundation reserves the right to remove, suspend, or decline any campaign that violates these rules, with or without prior notice, and to take any further action we deem appropriate.

9. Donations, Fees & Payment Processing

Payments on the Platform are handled by a secure third-party payment processor (for example, Stripe). Good Heart Foundation does not collect or store full payment card numbers on its own servers; your payment information is transmitted directly to and processed by the payment processor under its own terms and security standards.

By submitting a donation, you authorize Good Heart Foundation and its payment processor to charge your chosen payment method for the amount you select, plus any applicable fees disclosed at checkout. You agree that:

  • Fees. Platform and payment-processing fees may apply and, where charged, will be disclosed to you at or before checkout. Some donors may choose to cover these fees so that more of their gift reaches the cause.
  • Currency. Unless stated otherwise, donations are processed in U.S. dollars (USD).
  • Authorization. You represent that you are authorized to use the payment method provided and that the information you supply is accurate.
  • Disputes & chargebacks. If you have a concern about a charge, we ask that you contact us first so we can resolve it quickly — this is usually faster than a bank dispute. Filing a chargeback or payment dispute in bad faith, or to abuse the donation or refund process, is prohibited.

For details on how your payment and personal data are handled, please see our Privacy Policy.

10. Recurring (Monthly) Donations

If you choose to make a recurring (monthly) donation, you authorize Good Heart Foundation and its payment processor to automatically charge your payment method the amount you selected on a recurring monthly basis until you cancel. Each recurring charge is processed under the same authorization you provide when you set up the donation.

You can cancel a recurring donation at any time. To cancel, simply contact us with the details from your confirmation email, and we will stop all future charges. Please note that cancellation applies only to future charges — donations that have already been processed are generally final and are not retroactively refunded, except as described in our Refund & Cancellation Policy.

11. Tax Receipts & Deductibility

After your donation is processed, you will receive a receipt confirming your contribution. Whether a donation is tax-deductible depends on applicable law and on the nature of the campaign and beneficiary. Contributions are deductible only to the extent permitted by law, and some campaigns — for example, those benefiting a specific individual — may not be tax-deductible.

Good Heart Foundation does not provide tax, legal, or accounting advice, and nothing on the Platform should be relied upon as such. We encourage you to consult a qualified tax advisor regarding the deductibility of your specific contribution and your individual circumstances.

12. User Content & License

You may submit content to the Platform, such as campaign descriptions, titles, images, photos, videos, comments, and messages ("User Content"). You retain ownership of your User Content, but by submitting it you grant Good Heart Foundation a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, use, reproduce, display, publish, adapt, and distribute that content in connection with operating, promoting, and improving the Platform.

You represent and warrant that you own or have the necessary rights to your User Content, that it is accurate and not misleading, and that it does not infringe or violate the intellectual property, privacy, publicity, or other rights of any third party, or any applicable law. Good Heart Foundation may, but is not obligated to, review, monitor, or remove User Content, and may remove or disable any content at its discretion, including content that violates these Terms.

13. Acceptable Use & Prohibited Conduct

When using Good Heart Foundation, you agree not to:

  • Create false, misleading, or fraudulent campaigns, or misrepresent your identity or affiliation, or impersonate any person or organization;
  • Harass, threaten, defame, abuse, or harm other users, organizers, or beneficiaries;
  • Upload or share content that is defamatory, obscene, unlawful, or that infringes intellectual property or other rights;
  • Use bots, scrapers, crawlers, or other automated tools to access, collect, or harvest data from the Platform;
  • Attempt to gain unauthorized access to any part of the Platform, accounts, systems, or networks, or circumvent security measures;
  • Introduce viruses, malware, or other harmful code, or otherwise interfere with, disrupt, or overload the Platform or its infrastructure;
  • Abuse the donation or refund process, or file fraudulent payment disputes or chargebacks;
  • Use the Platform for money laundering, tax evasion, or any other unlawful or prohibited purpose.

14. Intellectual Property

All content and materials on the Platform that are not User Content — including the Good Heart Foundation name, logo, trademarks, text, graphics, design, and software — are owned by or licensed to Good Heart Foundation and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from this content without our express written permission.

Subject to your compliance with these Terms, Good Heart Foundation grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purpose of browsing campaigns and making donations. This license does not include any right to resell, commercially exploit, or republish the Platform or its content.

15. Copyright & DMCA / Takedown

Good Heart Foundation respects intellectual property rights and expects its users to do the same. If you believe content on the Platform infringes your copyright, please send a written notice to contact@goodheartfoundation.co that includes:

  • Your physical or electronic signature and contact information;
  • Identification of the copyrighted work you claim has been infringed;
  • Identification of the material you claim is infringing and its location (URL) on the Platform;
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Upon receiving a valid notice, we will respond as required by the Digital Millennium Copyright Act (DMCA) and may remove or disable the material. If your content was removed and you believe this was in error, you may submit a counter-notice. Good Heart Foundation maintains a repeat-infringer policy and may remove campaigns or restrict access for users who repeatedly infringe the rights of others.

16. Third-Party Services & Links

The Platform relies on and may link to third-party services, including our payment processor (e.g., Stripe), analytics providers, and advertising pixels (e.g., Meta/Facebook and TikTok), as well as external websites. These third parties operate under their own terms and privacy policies, and your interactions with them are governed by those terms.

Good Heart Foundation does not control and is not responsible for the content, policies, availability, or practices of third-party services or websites, and the inclusion of any link or integration does not imply our endorsement. Please review the relevant third party's terms and policies before using its services. For more on how we and these providers handle data, see our Privacy Policy.

17. Privacy

Your privacy matters to us. Our Privacy Policy explains what information we collect, how we use it, the analytics and advertising technologies we use, and the choices available to you. By using the Platform, you acknowledge that you have read and understood the Privacy Policy, which is incorporated into these Terms by reference.

18. Disclaimers; "As Is" / No Warranty

The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law.

Good Heart Foundation does not independently verify, endorse, or guarantee every campaign, organizer, statement, or beneficiary on the Platform, and does not guarantee that funds will be used as described or that any campaign will achieve its stated purpose or goal. While we take reasonable steps to promote trust and safety, you acknowledge that giving involves risk, that you are responsible for evaluating a campaign before contributing, and that you assume that risk. We do not warrant that the Platform will be uninterrupted, timely, secure, or error-free.

19. Limitation of Liability

To the fullest extent permitted by law, Good Heart Foundation and its officers, directors, employees, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of funds, data, goodwill, or reputation, arising out of or relating to your use of (or inability to use) the Platform, even if advised of the possibility of such damages.

Good Heart Foundation acts as a platform intermediary and is not responsible for the actions, conduct, omissions, or representations of campaign organizers, donors, or other third parties. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the Platform shall not exceed the greater of (a) the total amount of fees Good Heart Foundation retained from your donation(s) in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

20. Indemnification

You agree to indemnify, defend, and hold harmless Good Heart Foundation and its officers, directors, employees, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your User Content or your campaign; (c) your violation of these Terms or of any applicable law; or (d) your violation of the rights of any third party. Good Heart Foundation reserves the right to assume the exclusive defense of any matter subject to indemnification, in which case you agree to cooperate with us.

21. Termination & Suspension

Good Heart Foundation reserves the right to suspend, restrict, or terminate your access to the Platform or any campaign at any time, with or without notice, for any reason, including a violation or suspected violation of these Terms, suspected fraud or misuse, or to comply with law. We may also remove or disable campaigns and content at our discretion.

Upon termination, your right to use the Platform will immediately cease. Provisions that by their nature should survive termination — including those relating to intellectual property, User Content licenses, disclaimers, limitation of liability, indemnification, dispute resolution, and general provisions — will survive.

22. Dispute Resolution, Binding Arbitration & Class Action Waiver

Please read this section carefully — it affects your legal rights.

Informal resolution first. We want to resolve any concern quickly and fairly. Before starting formal proceedings, you agree to first contact us at contact@goodheartfoundation.co and give us at least 30 days to resolve the dispute informally.

Binding arbitration. If we cannot resolve a dispute informally, you and Good Heart Foundation agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Platform will be resolved by final and binding arbitration administered under the rules of a recognized arbitration provider, on an individual basis, rather than in court, except as provided below. The arbitration will take place in the United States.

Class action waiver. You and Good Heart Foundation agree that disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.

30-day opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to contact@goodheartfoundation.co with your name and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms.

Small-claims carve-out. Nothing in this section prevents either party from bringing an individual claim in a small-claims court for disputes within that court's jurisdiction, or from seeking injunctive or equitable relief for intellectual-property or unauthorized-use claims.

23. Governing Law & Jurisdiction

These Terms and any dispute arising out of or relating to them or the Platform are governed by and construed in accordance with the laws of the United States and, to the extent applicable, the laws of the state in which Good Heart Foundation is organized, without regard to conflict-of-laws principles. Subject to the Dispute Resolution section above, you agree that any permitted court action will be brought exclusively in the courts located in the United States, and you consent to their personal jurisdiction and venue.

24. Force Majeure

Good Heart Foundation will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, fire, flood, epidemics or pandemics, war, terrorism, civil unrest, labor disputes, governmental action, power or internet failures, or the acts or omissions of third-party service providers such as payment processors or hosting providers.

25. Changes to the Platform & to These Terms

Good Heart Foundation may modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We may also update these Terms from time to time. When we make material changes, we will post the updated Terms on this page and revise the "Last updated" date above.

Changes become effective when posted. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, please stop using the Platform.

26. Electronic Communications & Consent

By using the Platform or making a donation, you consent to receive communications from us electronically, including confirmations, receipts, and notices, by email or by postings on the Platform. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. Please ensure the email address you provide at checkout is accurate so that you receive your receipt and any important notices.

27. General Provisions

  • Entire agreement. These Terms, together with our Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and Good Heart Foundation regarding the Platform and supersede any prior agreements.
  • Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
  • No waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
  • Assignment. You may not assign or transfer these Terms without our prior written consent. Good Heart Foundation may assign these Terms in connection with a merger, reorganization, or transfer of assets.
  • Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
  • Survival. Provisions that by their nature should survive termination of these Terms will continue to apply after termination.
